Terms of Purchase, Delivery and Privacy Policy

1. Uniqueness of Products
All items in our shop (paintings, digital designs, souvenir products) are original author’s works created within a creative project and released in a limited edition of up to 100 copies of each design. These are collectible items with artistic value. Each carries the author’s signature or a digital certificate of authenticity.
⚠ For this reason, we do not offer returns or exchanges for such items. Please take this into account before placing an order.
2. Right of Withdrawal
Pursuant to Art. L.221-28 of the French Consumer Code, the right of withdrawal does not apply to: goods made to the consumer’s specifications; limited-edition artworks; products with unique creative characteristics; digital content where the download has already begun with the buyer’s consent (pt. 13).
🔒 All our products fall under these categories. Returns are only possible in exceptional cases (see Sec. 5).
3. Order Processing Times
We strive to dispatch all orders as quickly as possible. However, processing may take up to 2 business days (excluding weekends and public holidays in France), especially during peak periods or holidays.
⏱ If you need express delivery, please inform us before payment. We will do our best to help, although priority fulfilment is not guaranteed.
4. Delivery, Inspection of Goods and Liability
🚚 Carrier Responsibility
We are not responsible for delivery after the parcel has been handed over to the carrier (La Poste, Colissimo, Mondial Relay, etc.). All risks related to transport (delay, loss, damage) lie with the delivery service. In case of issues, please contact the carrier with the tracking number.
📦 Insurance
We do not insure goods valued up to €50. In case of their loss or damage, compensation is not provided. 🔐 If desired, you can order additional insurance or reinforced packaging — just inform us before payment.
📝 If the Parcel Is Damaged
In case of damage:
— be sure to request a report (constat de détérioration) at the post office;
— if the post office refuses or you are in doubt — you have the right not to accept the parcel.
📋 Refusal to accept does not guarantee an automatic refund — it is the first legal step to protect your rights.
⏱ Post-Delivery Inspection
If the parcel was left without your presence (in a letterbox, at a pickup point, with neighbours) — you have 48 hours from delivery to check the contents and inform us of any issue. We do not guarantee a refund or replacement, but we always try to help if the claim is timely and substantiated.
5. Returns (Exceptional Cases Only)
Returns are possible only after written approval and solely in the following cases:
- manufacturing defect (confirmed by photo/video);
- packing error (wrong item, damaged copy, etc.).
The item must be unused, in its original condition, and in the original packaging.
📦 Return shipping costs are borne by the buyer unless otherwise agreed in writing.
6. Payment
We accept payment by bank cards (Visa, Mastercard, AmEx), via PayPal, as well as Apple Pay and Google Pay. 💳 The order is considered confirmed after successful receipt of payment. Payment is made in euros. All transactions are encrypted and processed through certified platforms.
7. Taxes and Customs Duties
All parcels are dispatched from France. 🌍 For international deliveries, the buyer is responsible for paying duties, taxes and fees according to the rules of the destination country. The buyer is also responsible for providing any additional documents required by customs.
⚠ These costs are not grounds for order cancellation or a refund.
8. Sales Across Different Platforms
Our products are simultaneously listed on the official website, in the Shopify store, on Etsy, in galleries, and at fairs and festivals. ⚠ We try to update availability as quickly as possible, but sometimes items may be sold out earlier. In such cases we will inform you immediately, refund your payment or offer an alternative (if available).
9. Visual Perception
Product images are taken under studio lighting. ⚠ Colours may vary slightly due to screen settings, device type, and lighting. This is not considered a defect and is not a basis for return.
10. Storage of Uncollected Parcels
If a parcel is returned due to an incorrect or incomplete address, refusal to accept, or lack of response at delivery — we can resend it at your expense.
📋 If the buyer does not contact us within 14 days after the return — the order is considered cancelled without an automatic refund.
11. Personal Data Processing (GDPR)
We respect your privacy and comply with Regulation (EU) 2016/679 (GDPR). Data is collected solely for order fulfilment, delivery, customer support and compliance with legal obligations.
11.1. What Data We Collect
- Contact details: name, delivery/billing address, phone, e-mail.
- Payment data: card/account details (processed by payment providers), payment confirmations, payment method.
- Account data: username, password, preferences and settings.
- Order and transaction data: viewed items, basket, wishlist, purchases, returns/exchanges/cancellations, order history.
- Communications: messages you send us (customer support, etc.).
- Device data: IP address, browser, device type, identifiers, language, connection.
- Usage data: how and when you interact with the site (cookies, event logs).
11.2. Sources of Data
- Directly from you — when placing an order, creating an account, contacting support.
- Automatically — through the operation of the site (cookies/analytics).
- From service providers — payment systems, delivery services, technical providers.
- From partners/third parties — when needed to fulfil the order or permitted by law.
11.3. Purposes and Legal Bases of Processing
- Contract performance — processing and delivering the order, invoicing, account management.
- Legitimate interest — service improvement, analytics, fraud prevention, protection of our rights.
- Legal obligation — tax/accounting, responses to lawful requests from authorities.
- Consent — marketing communications (you can opt out at any time).
11.4. Sharing Data with Third Parties
- Platform and hosting: Shopify (technical processing and storage).
- Payment providers: e.g., PayPal/banking services — for secure payment processing.
- Delivery: postal/courier services — for order fulfilment.
- Analytics/security: services that help improve the site and detect fraud.
- By law or with your consent — where required by legal norms or you explicitly permit such sharing.
We do not sell your personal data to third parties.
11.5. Your Rights
You have the right to: access; rectify inaccuracies; erasure (“right to be forgotten”); restrict or object to processing; data portability; withdraw consent (where processing is based on consent). 11.6. Storage and Security
We apply technical and organisational protection measures (SSL encryption, access restrictions, logging). Data is stored no longer than necessary for: order fulfilment, accounting/tax purposes, dispute resolution and compliance with the law. No system can guarantee “absolute” security, so please do not send via unsecured channels information that we do not need to fulfil your order.
11.7. International Transfers and Children
International transfers: Shopify and certain providers may process data outside the EEA/UK. Such transfers use recognised mechanisms (e.g., EU Standard Contractual Clauses — SCC) or to countries with an adequacy decision.
Children’s data: our services are not intended for persons under 16 years of age. We do not knowingly collect children’s personal data; if this has occurred — please contact us for deletion.
12. Legal Basis and Jurisdiction
These terms are based on: the French Consumer Code (L.221-28); EU Directive 2011/83/EU; the UN Convention CISG; Regulation (EU) 2016/679 (GDPR); the requirements of the Shopify and Etsy platforms. The legally binding version of this document is the French version. All disputes are governed by French law by the competent court at the seller’s registered address.
13. Third-Party Sites and Links
Our site may contain links to third-party resources. We are not responsible for their terms and privacy policies and recommend reviewing them separately. Information posted in public areas (including social networks) may be visible to other users beyond our control.
14. Changes to the Policy
We may update this policy following changes in legislation or shop operations. The updated version is always published on the official website with an update date.
